Terms and Conditions of the Registration and Management of 
.INFO Domains through HubNut Limited

The Terms and Conditions below are to protect our customers from the activities of others and do not affect your rights & obligations under the consumer protection laws currently in force, including, but not limited to:

  • The Trade Descriptions Act 1968.
  • The Consumer Credit Act 1974.
  • The Sale of Goods Act 1979.
  • The Supply of Goods & Services Act 1982.
  • The Unfair Contract Terms Act 1977 & The 1994 Regulations.
  • The Consumer Protection Act 1987.
  • Consumer Protection (Distance Selling) Regulations 2000.

 

We act as your agent to purchase domains through CSL GmbH who are an accredited Member of ICANN
 

HubNut Limited acts as you agent in the purchase and or management of .info  domain names.  As your agent HubNut Limited:

  • will consider all submitted requests for domain name registration and accept or reject them in accordance with guidelines set by CSL GmbH, Afilias Domain Registry and ICANN.

  • will upon acceptance of registration requests submit names for registration and make full registration upon receipt of payment.

  • will do all we can to ensure that the registrant's details are submitted correctly during registration.

  • will pay the initial registration fee and renewal fees for the registration to CSL GmbH on receipt of payment from the applicant.

As the domain applicant :

  • The customer agrees that Afilias [www.afilias.com], the registry of domains below the .info TLD, and its employees and agents are entitled to use, copy, publish or otherwise process person-related data supplied by the customer in order to perform its obligations under the agreement. This does not affect the provisions of article 3 of the General Terms and Conditions of outlined below.
     

  • You agree to be bound by the Terms and Conditions of HubNut Limited, CSL GmbH, Afilias and ICANN in the registration of .info domains outlined in the abridged Registration Agreement  below.  The full CSL GmbH agreement may be found here.

In addition:

  • Once a registration request has been completed no refunds for the registration will be made by HubNut Limited.

  • HubNut Limited reserve the right to halt the registration or transfer/release of a domain name if outstanding monies are owed to them by the registrant.

  • HubNut Limited process domain registration requests on a first come, first served basis. Until the registrant receives confirmation of registration from HubNut Limited there is no guarantee that the domain name requested will be registered.

  • HubNut Limited may cancel or halt domain name registrations under certain circumstances, including a) completion of the registration puts HubNut Limited in conflict with guidelines set by CSL GmbH or ICANN b) HubNut Limited believe that there may be conflicts of rights to a particular name.

  • The applicant indemnifies HubNut Limited from any legal proceedings and costs that arise as a result of the registration of a domain name.

     
     

Registration Agreement


This Registration Agreement ("Agreement") sets forth the terms and conditions of your use of HubNut Limited and Computer Service Langenbach GmbH ("CSL"), to register a domain name on the Internet. To complete the registration process, you must read and agree to be bound by all terms and conditions of this Agreement, the accompanying fee schedule and dispute policy, and any rules or policies that are or may be published by HubNut Limited and/or CSL.  You acknowledge that CSL may modify this Agreement if necessary to comply with its ICANN Agreement, or otherwise.
 

1. Fees
 
As consideration for the domain name registration services provided by HubNut Limited, as your agent, and CSL through which your application is processed, you shall pay all applicable initial registration fees and renewal fees to HubNut Limited. You will be notified when renewal fees are due, and it shall be your responsibility to ensure that such fees are paid. Should these fees go unpaid by the time specified in the renewal notice, your registration will be cancelled. You agree that HubNut Limited and/or CSL shall have no liability whatsoever with respect to any such cancellation.
 

2. Dispute Policy

You agree to be bound by the current ICANN Domain Name Dispute Policy ("Dispute Policy") which is incorporated into this Agreement by reference. The Dispute Policy can be found at dispute-policy. Any disputes regarding the right to use your domain name will be subject to the Dispute Policy. CSL may modify the Dispute Policy in its sole discretion at any time. Your continued registration of your domain name after modification to the Dispute Policy becomes effective constitutes your acceptance of those modifications. If you do not agree to such a modification, you may request that your domain name be deleted.
 
You agree that you will be subject to the provisions specified in the Dispute Policy in effect at the time your domain name is challenged by a third party. You also agree that in the event a domain name dispute arises with any third party, you will indemnify and hold HubNut Limited and/or CSL harmless pursuant to the terms and conditions contained in the Dispute Policy.
 

3. Use of Your Information
 
As part of the registration process, you are required to provide certain information and to update this information to keep it current, complete and accurate. This information includes your full name, postal address, e-mail address, voice telephone number, and fax number if available.  You should be aware that this information will appear in the publicly available Whois data.
 
You acknowledge that willfully providing inaccurate information or willfully failing to update information promptly will constitute a material breach of this Agreement and will be a basis for cancellation of your domain name. If you license use of a domain name to a third party, you are nonetheless the holder of record of the domain name and are responsible for providing your own full contact information.

You acknowledge that CSL will make some of the information that you provide during the registration process publicly available as required by ICANN. Additionally, you acknowledge that ICANN may impose guidelines, limits and/or requirements that relate to the amount and type of information that CSL may or must make available to the public or to private entities. HubNut Limited and/or CSL will not otherwise disclose your information to any third party unless it is required to maintain your domain name. You may request a copy of your information in HubNut Limited's and/or CSL's possession to review, modify or update such information.
 

4. Use Policies
 
CSL and Afilias reserves the right to suspend or cancel your domain name in the event that you use the domain name to send unsolicited commercial advertisements in contradiction to either applicable laws or customary acceptable usage policies of the Internet, or if you use your domain name in connection with unlawful activity.


5. Agents and Licenses

You agree to be bound by all terms and conditions provided herein, including the Dispute Policy.  HubNut Limited acts as your agent in domain registration.

You agree that if you license the use of your domain name to a third party, you re-main the domain 
name holder, and remain responsible for all obligations under this Agreement.
 

6. Indemnity
 
You agree to defend, indemnify and hold harmless HubNut Limited and/or CSL and any applicable domain name registry, including Network Solutions, Inc., and the directors, officers, employees and agents of each of them, for any loss, damages or costs, including reasonable attorneys' fees, resulting from any third party claim, action, or demand related to your domain name or the use thereof. This indemnification is in addition to any indemnification required under the Dispute Policy.
 

7. Representations and Warranties
 
You represent and warrant that all information provided by you in connection with your registration is complete and accurate. HubNut Limited and/or CSL makes no representation or warranties of any kind in connection with this Agreement. HubNut Limited and/or CSL does not represent or warrant that registration of your domain name will immunize you from challenges to your domain name.
 

8. Breach and Revocation
 
Any breach by you of this Agreement or the Dispute Policy must be remedied by you within 30 days of notice.  CSL and the Afilias registry reserve the right to refuse, delete or transfer registrations at their discretion if necessary to maintain orderly operation of the registry, comply with statutory or official regulations, on the instruction of a public prosecutor, within the framework of the above regulations or to avoid civil or criminal liability of CSL or Afilias registry or their employees. CSL and Afilias registry also reserve the right to “freeze” a .info domain during current proceedings.

You also agree that HubNut Limited, and/or Afilias, and/or CSL shall have the right in its sole discretion to revoke, suspend, transfer or otherwise modify a domain name registration upon seven (7) calendar days prior written notice, or at such time as HubNut Limited and/or Afilias, and/or CSL receives a properly authenticated order from a court of competent jurisdiction, or arbitration award, re-querying the revocation, suspension, transfer or modification of the domain name registration.
